Content Licence Agreement

1. Introduction

This Content Licence Agreement ("Agreement") is a legally binding contract between you ("Creator", "you", or "your") and VelvetElite ("Platform", "we", "us", or "our") that governs the use of any content you upload, submit, or share on our platform.

By uploading content to VelvetElite, you agree to the terms set forth in this Agreement. This Agreement is supplementary to and should be read in conjunction with our Terms and Conditions.

2. Content Ownership

2.1 Your Ownership Rights: You retain full ownership of all content you upload to VelvetElite. Uploading content does not transfer ownership rights to us. Your intellectual property remains yours.

2.2 Limited Licence Grant: By uploading content, you grant VelvetElite a limited, non-exclusive, revocable licence to display, host, and distribute your content solely for the purpose of operating the Platform and providing our services to you and Platform users.

2.3 Licence Termination: The licence granted to VelvetElite automatically terminates when you delete your content or close your account, subject to reasonable technical processing time and any legal retention requirements.

4. How Your Content IS Used

Your content is used only for the following legitimate Platform purposes:

• Profile Display: Showing your content on your creator profile to Platform users
• Search Results: Including your profile in search and discovery features
• Thumbnails: Creating resized versions for faster loading and preview displays
• Content Delivery: Storing and delivering your content via secure content delivery networks
• Moderation: Manual human review to ensure compliance with our content policies
• Legal Compliance: Responding to valid legal requests from law enforcement where required by UK law

5. Your Warranties

By uploading content to VelvetElite, you warrant and represent that:

• You are the sole owner or have obtained all necessary rights and permissions for the content
• All individuals depicted in your content are at least 18 years of age
• All individuals depicted have given their explicit, informed consent to appear in the content
• Your content does not infringe upon any third-party intellectual property rights
• Your content is authentic and has NOT been created or manipulated using AI or deepfake technology
• Your content complies with all applicable UK laws and regulations

6. Content Removal and Account Closure

6.1 Right to Remove: You may remove your content at any time through your account settings. Upon removal, we will delete your content from our active systems within a reasonable timeframe.

6.2 Account Closure: Upon closing your account, all your content will be scheduled for deletion. Some data may be retained as required by UK law for record-keeping purposes.

6.3 Backup Copies: While we endeavour to delete all copies of your content, cached or backup versions may persist for a limited time due to technical processes. These will be removed during routine system maintenance.

7. Breach and Enforcement

7.1 Our Commitment: If VelvetElite breaches any provision of Section 3 (Prohibited AI Use), you may be entitled to seek legal remedies including injunctive relief and damages under UK law.

7.2 Your Breach: If you upload content that violates this Agreement, including AI-generated content or content depicting individuals without consent, your account will be immediately and permanently terminated, and we may report violations to relevant authorities.

8. Data Protection

All content and personal data is processed in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and our Privacy Policy. You have the right to access, rectify, and erase your personal data as detailed in our Privacy Policy.

9. Governing Law

This Agreement is governed by and construed in accordance with the laws of England and Wales. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to This Agreement

We may update this Agreement from time to time. Material changes will be notified via email or prominent notice on the Platform at least 30 days before taking effect. Continued use of the Platform after changes constitutes acceptance of the modified Agreement.
